A pile of GLP-1 injector pens

GLP-1 Injuries or Illness

These new drugs have been heralded as revolutionary for weight loss. Users and researchers, however, have connected them to horrific potential side effects such as gastroparesis (stomach paralysis) and more recently, a blinding eye disease called non-arteritic anterior ischemic optic neuropathy (NAION).

What are GLP-1 claims about?

  • 📆

As of July 1, 2024, the federal Judicial Panel on Multidistrict Litigation reported that 105 cases have been filed into a consolidated lawsuit in a Pennsylvania federal court.

  • 📋

The consolidated federal claims are being pursued by patients who suffered a form of stomach paralysis known as gastroparesis (“frozen stomach”) or similar effects while taking the drugs.

  • 🔎

The drugs included in the consolidated cases include Ozempic, Wegovy, Rybelsus, Trulicity, and Mounjaro.

  • 🏥

Patients who may qualify for these claims developed stomach or eye disease while taking one of these medications, received a diagnosis connecting the illness to their use, and suffered serious adverse effects like hospitalizations, missed work, etc.

  • 🏛

Consolidated cases like this, MDL No. 3094, follow special rules and procedures that differ from ordinary lawsuits. Most often, they do not require the same level of participation from the injured person as an individual case.

  • 💼

Lawyers (like us) with experience handling these complex dockets can make the experience much smoother and take all necessary steps to provide the best chance at full compensation.

Frequently asked weight loss drug claim questions

  • According to the NIH’s National Institute of Diabetes and Digestive and Kidney Diseases, “Gastroparesis, also called delayed gastric emptying, is a disorder that slows or stops the movement of food from your stomach to your small intestine, even though there is no blockage in the stomach or intestines.” “The symptoms of gastroparesis may include feeling full shortly after starting a meal, feeling full long after eating a meal, nausea, and vomiting.”

  • NAION stands for "non-arteritic anterior ischemic optic neuropathy." It's a leading cause of blindness among adults. An observational study in JAMA Opthomology found that "prescribed Semaglutide is associated with an increased risk of NAION."

  • An MDL is a group of consolidated lawsuits in federal court. These cases are created by a panel of federal judges called the Judicial Panel on Multidistrict Litigation (or JPML). The JPML groups cases together in an MDL when they are likely to share common issues, but many MDL’s are NOT class actions. That means if you want to bring a claim, you can’t just sit back and wait to get a notice in the mail.

  • This is case specific, and in general it is truly too early to say. In most successful drug MDLs, individual payments can be very substantial. Of course, not all claims or cases are successful. An experienced complex case lawyer can help you maximize your recovery.

  • You shouldn't. Like most law firms that handle these cases, we never charge out-of-pocket attorneys fees. We only get paid if we win your case, and our fee is limited to a portion of your recovery.

  • Like most things, it depends. MDLs can last for several years, but sometimes claims can be settled much sooner. In some instances, people who file their claims early on are the first to see resolutions.
